Article 2 — Scope
These terms and conditions of sale govern all sales of jewellery made on the ICE COLD JEWELRY website between ICE COLD JEWELRY and any consumer customer. Placing an order implies full acceptance of these terms, which are available on the website at all times.
Article 3 — Products
Online shop: the jewellery available for direct purchase is set with moissanite. Its essential characteristics (material, finish, dimensions, sizes) are shown on each product page.
Custom: custom pieces are made and hand-set according to the customer's request, in 14, 18 or 22 carat gold or 925 silver, with natural diamonds, lab-grown diamonds or moissanite. They are subject to a quote and prior approval (sketch, 3D model) before production.
Photographs are as accurate as possible but not contractual.
Article 4 — Prices
Prices are shown including all taxes, excluding shipping costs. Shipping costs are shown before the order is confirmed. Orders delivered outside the European Union may be subject to import duties and taxes in the destination country. ICE COLD JEWELRY reserves the right to change its prices at any time; products are invoiced at the price in force when the order is placed. The price of a custom piece is the one in the quote accepted by the customer.
Article 5 — Orders
The customer selects their items, fills in the requested information (including, for personalised jewellery, the text to be made), checks the order summary and confirms it by paying. An e-mail confirming the order is then sent. The customer is responsible for the accuracy of the personalisation text they enter.
For custom work, the order is final once the customer has accepted the quote and approved the design and, where applicable, paid the deposit set out in the quote.
Article 6 — Payment
Payment is due when the order is placed. It is made securely by bank card and the other methods offered at checkout, including instalment payment where available. The order is only processed once payment has been confirmed.
Article 7 — Delivery
Products are delivered worldwide to the address provided by the customer. Online shop: delivery within one to two weeks. Custom: timeframe agreed with the customer. Full details (costs, tracking, customs) are set out in our Shipping policy.
Article 8 — Right of withdrawal
Consumer customers have 14 days from receipt to withdraw from the purchase, except for goods made to their specifications or clearly personalised (custom pieces, personalised jewellery, set watches), in accordance with article L.221-28 of the French Consumer Code. Details are set out in our Returns and refunds policy.
Article 9 — Legal guarantees
All our products are covered by the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Under the legal guarantee of conformity, the consumer has two years from delivery to act. They may obtain repair or replacement of the item or, failing that, a price reduction or cancellation of the sale, under the conditions set by law. Under the guarantee against hidden defects, they may obtain cancellation of the sale or a price reduction within two years of discovering the defect.
These guarantees do not cover normal wear, damage caused by impact, misuse or improper care (contact with perfume, chlorine, sea water or chemicals), or natural wear of a plated finish.
Article 10 — Liability
ICE COLD JEWELRY cannot be held liable for failure to perform the contract caused by the customer, a third party or force majeure.
Article 11 — Intellectual property
Designs, sketches and 3D models made by ICE COLD JEWELRY remain its property. The customer guarantees that they hold the rights to any logos, images or texts they provide for personalisation or a custom piece.
Article 12 — Personal data
Data collected is processed in accordance with our Privacy policy.
Article 13 — Mediation and disputes
If a problem arises, the customer is invited to contact ICE COLD JEWELRY first at icecoldjwlry@gmail.com to find an amicable solution. In accordance with articles L.612-1 et seq. of the French Consumer Code, consumer customers may use a consumer mediator free of charge to resolve the dispute amicably.
These terms are governed by French law. Failing an amicable agreement, the French courts have jurisdiction, subject to mandatory rules protecting consumers.
